Some leaders are targeted for political, religious, or other reasons. History often looks upon these persons either as a hero or as a villain depending on their legacy.
I would say the same for Maximilian of Mexico. If after a regime change, you're getting sentenced by court martial and then a firing squad kills you, that's not assassination.
